India makes preliminary anti-dumping ruling on aluminum foil from China
On August 28, 2024, the Indian Ministry of Commerce and Industry issued a notice announcing the preliminary anti-dumping ruling on aluminum foil with a thickness not exceeding 80 microns originating from or imported from China. According to the ruling, it is recommended to impose temporary anti-dumping duties on Chinese related products, with a tax rate range of 619 to 873 US dollars per ton. Specific taxation details can be found in the attached announcement. The products covered by this anti-dumping investigation are classified under multiple Indian customs codes, including 76071190, 76072090, etc
However, some specific aluminum foil products are not within the scope of this investigation, such as non capacitor aluminum foil with a thickness of less than 5.5 microns, as well as nine types of aluminum foil products for specific purposes, including ultra lightweight conversion aluminum foil and electrolytic capacitor specific aluminum foil. The detailed instructions for these excluded products have been clearly listed in the announcement.
The cause of this anti-dumping investigation can be traced back to March 21, 2024, when the Indian Ministry of Commerce and Industry decided to launch an anti-dumping investigation on Chinese aluminum foil based on a joint application from multiple local companies, such as Hindalco Industries Ltd., Shyam Sel&Power Ltd., etc. The applicant company not only pointed out the existence of dumping behavior of Chinese products, but also emphasized the potential damage caused to the domestic industry in India by such behavior, and requested retroactive collection of dumping duties.
The specific reasons of the applicant include: Chinese aluminum foil products have a long history of dumping in the Indian market; Indian importers are aware of the dumping behavior of Chinese exporters and its negative impact on their domestic industries; The sustained high dumping rate during the investigation period indicates the exporter's large-scale dumping strategy; And during this period, the operating conditions of India's domestic aluminum foil industry significantly deteriorated.
